As an example of the utter failure of porno producers to police teh internets, and just how bad it's gotten, here's a simple example.

1. While checking my e-mail last night, I get a message from Naughty America asking me to rejoin and giving me the following "exclusive:" "Valued Customer, We're giving you two good reasons to renew your Naughty America membership: Brooke Banner and Jenni Lee. But that's not all. With your renewal you'll also get to enjoy Banner and Lee's other scenes, as well as access all of our sites...."



Fair enough, they want my business. I've subscribed on and off for many years now. Note the time and date of the message, 5 Sep 2008, 1956 MST.

2. Just for shits and giggles, I plugged some keywords into Google after receiving that e-mail, and was directed to a file sharing message board, where the following was posted:



Note the time and date of this message: Friday 5 Sep 2008 1929 MST. The obvious key here is that the pirates had already downloaded, coded, reuploaded, made screen captures and posted a stolen version before the producer even had a chance to market to me. By the way, I checked that message this morning, over 1,200 views. Assuming all of these 1,200 degenerates paid the $24.95 to subscribe, NA just missed out on almost $30M in revenue. $30M is two months worth of building lease payments in San Diego, it's the fees for shooting 25 anal scenes. It's a week's worth of cocaine for Powder and Wankus. Even if 10% of those perverts signed up, is $3 grand something to arrogantly dismiss?

Are porno people just lazy? Stupid? Or more likely, incapable of collectively joining forces to combat this. A few months ago, Tanya Danielle complained about a big ol' file sharing message board she came across. Have we heard anything more from this whore? Of course not. Even further back, some porno producers had a conference on how to fight this. Any more from them? Nope. With sales hitting your collective shitter, I always assumed business owners would try and maximize revenues any way possible...especially by thwarting theft.

But then again, I forgot this was porno...where business scruples go right out the door.

Jim.... in WHICH system of notation would the roman numeral M ever be used in that context. Please feel free to correct me, but i have never seen it used in that context even when i was an engineering student. I know in SI prefixes M stands for mega or 1,000,000...

your in the wrong context unless you are trading corporate bonds. if you implying that people are attempting to pay for the website in corporate bonds... then by all means... but thats the only time that notation applies that i am aware of. hence my saying "in that context".

Lets take a look at the above Word Problem and apply some common sense. Now would a two month lease be closer to 30 grand or 30 mill?. hmmm 25 anal scenes worth 30 mill?. suuure.. why not. Weeks worth of yayo for Worthless and Poofer.. well thats a push. I'll leave it up to the Engineers and what not to figure out the last line.

I think we can all agree on two points:

1. Porn piracy on the internet has gotten so bad it poses a serious thread to the whole adult industry.

2. The industry response so far has been almost non-existant.

Now, several questions come to mind.

1. How is it possible that pirates get their hands on all the release almost immidiately after they are released, sometimes even before. Do they buy all the content? Not likely. With sites like naughtyamerica they probably use hacked passwords that periodicaly apear on file sharing message boards but what about the DVDs? They probably use copies sent by studios to reviewers. Would it be too expensive to insert an unique watermark to every single reviewer's copy that would alow the studios to track down the cultprit?

2. Why don't the porn companies try harder to fight back against pirates. Do they simply lack funds and/or will to set aside their differences and fight the common enemy? Or are they simply convinced there's nothing that can be done to solve the problem? Why don't they at least make Mr. Marcus to his site's forum section of that shit? The Valley is probably full of big dicked black men that can take his place untill he actually does something to rectify the situation.

3. If piracy can't be technicaly stopped and more and more people get all their porn without paying a dime, is current prevailing business model viable on the long or even medium run?

as far as the DVD question its easy.... some of the distributors are responsible for the pirating, and for making pirate copies of the DVD to sell on their own.

When I lived in Korea and Japan I would have to pass by several old men selling dvd's before they made it to the theaters there. Also, all I would have to do is ask my 8-17 year old students to make me a copy of a movie and I'd have 4 or 5 copies the next day. Gotta love those hard working Asians.

Have you priced copyright lawyers? Most decent ones want a $15 or $20K retainer and won't look at a case with less than a $100K settlement.

Do the math. What does the average adult movie cost to produce and how much does it gross during it's few weeks of life?

It has nothing to do with feeling "uncomfortable" being in court discussing porn. It has to do with diminishing returns.
Usually, I would imagine, it's just not worth the effort.
Especially if you haven't registered your film for copyright, which most porn producers don't take the time and $ to do. This limits what you can recover in court only to your actual damages, no punitive awards.

1. Content can be copyrighted en masse. A web producer could copyright his/her website and its contents without having to pay for each new production. The Associated Press does not copyright each story it puts out.

2. From what I have read, reporting illegal content to file sharing websites is fairly easy, and doesn't take a $20M retainer from Jacoby & Meyers. There are evidently a few webwhores who are very assiduous at this and get their content taken down very quickly.

As for the "M' vs. "K" debate, I've worked for three of the largest banks in the U.S., and they all still use "M" as their notation of one thousand. So just shut it.

The bottom line is this...

Because catching someone (your paying) fucking on film is easy, the biggest retards get into the business. For the most part, porn 'companies' can barely figure out how to edit raw footage, let alone keep their works from getting ripped off in ten seconds.

Besides, when every porn producer is using fifty third-party VOD providers/distributors, it makes it pretty easy for some DVD copies to get into the 'wrong' hands - primarily because the third-parties don't give a fuck if the guy ripping and encoding the DVDs is saving copies on disk to take home for his buddies.

The thing is that the porno producers will never be able to fight the piracy. If mainstream Hollywood movies have difficult time fighting piracy then porners do not stand a chance.

And the thing is that ripping DVDs is just plain fucking easy. You don't even have to have really good computer for it, and you dont even have to be smart to figure stuff out, because someone already figured it for you. There are hundreds of boards that specialize in this "hobbyist" backups and video tinkering.
